It goes without saying that those who fail to plan, plan to fail. Bryan Garner, an American lawyer who has written countless treatises on legal writing, English usage, and advocacy suggests in his book, “Legal Writing in Plain English” that one must think through what he intends to write like a master planner. But not everyone is born with the fine strokes of a master planner.  Now, what Garner emphasizes is to achieve maximal efficiency through proper planning of writing projects.  You save words, you save time.  This course shares some of the ways to do it, specifically, the critical pre-work that goes before you file any pleadings at all. At the end of this module, you should be able to:
  • Distinguish the ways lawyers can organize their ideas,
  • Determine how to establish a theme that would stick in the mind of the judge,
  • Recognize the importance of listing the issues to be controverted,
  • Identify how intent can be leveraged, and
  • List pre-trial strategies.
